INTRODUCTION

Imagine a human without his socio-legal status in a particular society, he cannot recognised himself as citizens without basic human rights, birthright, constitutional rights or other civil rights or federal safeguards. To dismantling intiatives on  diversity, equity and inclusion for fostering innovative development approach in the Society, President Donald Trump in his first day of the second administration issued executive orders shortly just after sworn in to change the US government’s policies on two sex i.e. male and female. In previous administration, he has already curtail few practices such as aids treatment, banning transgender in military services, ending government support for minor gender healthcare,  decreasing budget for the transgender, denial of blood donation and this time reversing all efforts  and action taken by the Biden administration,  as he has made promised while complaining for the second term presidential election.^[1] Meanwhile, when Trump passing executive orders on two gender policy, he critics the Biden administration’s practices “unpopular, inflationary, illegal, and radical practices within every agency and office of the Federal Government”.^[2]

WHAT THE EXECUTIVE ORDER SAYS

In the executive orders which state that ‘Sex’ is not a synonym for and does not include the concept of ‘gender identity’. Secondly direction state that he revoked had been designed to address “racial equity and support for underserved communities.” In his opening speech, Trump used a different phraseology, saying, “To date, it would be the Official US government policy to have only two genders, male and female.” Trump has made a Broader promise of what conservatives suffered as a “wakening,” gender and diversity, equality And record (DEI) program. Another guidelines he revoked were “designed to be interested in racial Approval and support for communities under the department. President Donald Trump signed an Executive order on Monday. The US government has only recognized two genders, male and Female, ending two “radical” types, equity and inclusion programs for federal authorities.^[3] Executive order with the purpose of defending women from the extreme gender ideology and President said intent behind the order is the restoring  original biological truth if the government.

HOW THIS ORDER  IMPACT TRANSGENDER

Impact of the two gender policy of second Trump administration is much wider such as mental health, minor healthcare, Transgender students admissions in college, denial of participating in sports, ending of monetary supporting from federal administration, aids treatments, not safeguards measures for socio-legal by the government, huge impact on private transgender employees. However, few positively impact to women such as preferred gender identities as protection for women athelete seats in sports, women’s right restoring to use public toilets and bathroom, reduce in harrasment of women by man transgender and inheritance rights. In his speech, Trump explained that the government only recognizes the genders of two men and women. The Move breaks down the protections of a fierce battle and places trans students in a precarious Position. The guidelines provided a lifeline to those who did not need medical documents and did Not have IDs to traditional binary files. Trump’s management explicitly targets this practice. Impact on  transgender students, this guideline marks a loss more than merely symbolic perception. It threatens the ability to exist authentically in the school. People who have worked to match school documents to gender identities can go wildly wrong with Official documents. This not only disables students identity, but also allows to check it Unnecessarily and examine stigmatization and discrimination. Increased Vulnerability to Bullying Schools already struggling to promote an integrated environment can interpret federal directives as a licence of disregard or direct existence of guidelines for the protection of transgender students. A lack of systematic support can tighten up bullying and harassment, and students may be isolated and unsupported. Access to gender facilities such as toilets and changing rooms has long been a battlefield of trans Rights. Trump’s policies allow schools to reintroduce exclusion practices and force students into rooms that are at odds with their identity. Similarly, participation in gender-specific sports could Be another flashpoint that further alienates transgender students.^[4]

According to World Health Organization, rigid gender policy of the American administration can impact negatively, especially diverse gender identities who faces multiple violence, stigma and discrimination including healthcare.

HOW THE EXECUTIVE ORDERS VIOLATE TRANSGENDER RIGHTS

Executive actions of the federal government has violating many Constitutional, federal law, and civil rights such as equal protection, protection from discrimination, free from public workplace exploitation. Subsequently, immigration rights of those who have marked X on passport can be detected by the border agents in order to re-entry in USA and shelter rights and basic prisoner rights when trans women get transferred to male prison also get impacted through immediate effect of the Trump administration orders. Jennifer C. Pizer, the chief legal officer at Lambda Legal, a civil rights organization that litigates On behalf of LGBTQ Americans, said, expects organizations and others to sue the administration Through executives. “Like everyone else, we have the same property rights.” Start moving trans People into a room that suits your birth, as opposed to your gender identity. This means, for Example, trans women who serve time in prison women can move to men’s prisons in a short Period of time. Trump administration executive actions on transgender are unworkable and violate the regulations, which provide protection under Title VII, Title IX or other regulations established through legal procedures. This policy also encouraging discrimination against transgender in public space such as School, prison, health care, workplace,  public accommodations and others.

CONCLUSION

To maintain social order and balanceed sustainable innovative development in society, we must promote inclusive growth, where protection of human rights and basic neceescties of all society groups no matter which gender or sex. Trump government in his previous government has the same policy regarding the rights of the transgenders like exclusion from the blood donor and aids treatment,  ending provision for transgender minor healthcare and exclusion form military services. Trump government with the purpose of defending women’s rights, protection of freedom of conscience, reducing federal fund from diversity, inclusive, equity intiatives and restoration traditional way of defininig sex as man and women only. However, Two gender policy aim to eroding constitutional, federal regulations and others civil rights, basic socio-legal status by the current administration on the name of traditional meaning of sex or gender and treating american citizens on the basis of equal merits rather identity categories, which also emphasizes by the great Martin Luther King Junior.
